What’s Transitional Justice – when it’s at home?

I continue to think about the increasing divisiveness in our societies – and the apparently minimal efforts being made to repair the divisions. Or is this just a mirage – something created by a 24-hour media system which exults in scandals and bad news? Perhaps, under the surface, all is much better than we think. Perhaps the optimists like Stephen Pinker are right after all?

It is, of course, impossible to generalise – the world looks very different from a Chinese point of view. Each country needs its own assessment – ideally from a combination of internal and external sources. The UK, for example, perhaps suffers from a surfeit of such appraisals – of both sorts - starting with the prescient Suicide of a Nation edited by Arthur Koestler in 1963 which attracted Olympian disdain from none less than Philip Hobsbawm

After the Obama years, the USA has had, over the past 5 years, only its negative side portrayed - but two recent books offer the country some ideas for how it might rebuild. They are

The Upswing – how American came together a century ago and how we can do it again by Robert Putnam (2020) – the country’s best-known sociologist and

       -  A Time to build – how recommitting to our institutions can revive the American dream; Yuval Levin (2020) which builds explicitly on an important but neglected book written in 2009.

For the moment, my interest is focused on Bulgaria and Romania – and how such countries might extricate themselves from the vicious circle of hopelessness into which their citizens seem to be locked.

Political leaders of these countries, of course, would not agree with that description – but any reading of the annual Eurobarometer poll of EU citizens is inevitably drawn to the conclusion that the political institutions of central and south-eastern Europe lack legitimacy and public trust. One of Romania’s foremost political analysts – Dorel Sandor – wrote in 2018 a powerful article in which he confessed that he had given up any hope for the country - with this reliable source giving evidence for the loss of trust in the country.

A recent book - Romania Confronts Its Communist Past: Democracy, Memory, and Moral Justice; by Vladimir Tismaneanu and Marius Stan (2018) – reminds us of what lies behind this. Just over a decade ago – after some 15 years of the country being in denial about its past - a maverick President set up a Commission to investigate the communist era. This is the book in which its chairman recounts the experience and impact of the Commission.

I asked a young Bulgarian friend who is a journalist with an interest in Romanian affairs about what efforts either country had made toward “conciliation” in their divided societies – and was, of course, then made immediately aware of the fragility of the words we use when he asked for an explanation of what I meant by the term. I was aware that it is normally used to reference family and minor commercial disputes but I had forgotten that a new field has arisen – of Transitional Justice – into which academics (both Eastern and Western) have been crowding in the past decade. This includes the field of property restitution, lustrace and memory

And I have the feeling that few Bulgarians or Romanians have been let loose with what I would call “mediating skills” of the sort practised by Adam Kahane of the last post

Attempting the Impossible

The last post suggested that few authors had dared tackle the question of national success – choosing instead to focus on how nations fail. Of course, there are numerous books about economically successful countries – Ruchir Sharma is an investor who followed up his 2013 book Breakout Nations – in pursuit of the next economic miracles about the BRIC countries with 10 Rules of Successful Nations. And Turkish economist Murat Yulek recently produced a very thorough analysis How Nations Succeed – manufacturing, trade, industrial policy, economic lopment (2018)

But these focus exclusively on economic factors – or rather on the mix of policy, commercial and financial considerations which get an economy going.

The question which I want to explore is how the wider social system - consisting of the key government, business, trade union, media, academic, NGO, religious figures etc - might be persuaded in a polarised society to come together to forge a new beginning. But one with a reasonable chance of success…

I start with a particular interest in Bulgaria and Romania whose citizens, 30 years after the fall of the Berlin Wall, feel a strong sense of hopelessness captured, for example, in a despairing article in one of Romania’s cultural journals summarised here – with a follow-up explanatory note here. My understanding of a situation for which both external and internal actors are equally to blame is described in a longer 2018 post- 

- in the early 90s everyone (particularly outside Romania) expected too much although Ralf Dahrendorf - unique in his experience as both a German and British politician and one of the first academics in the 50s to explore the nature of the social changes which took place in Germany in the first half of the 20th century (Society and Democracy in Germany) - had warned in 1990 that real cultural change would take “two generations”. This means 50 years!

- Absolutely no preparations existed in 1989 for the possibility that communism might collapse and for the choices this would present for political, economic and legal systems …..Everyone had assumed that the change would be in the opposite direction. The only writings which could be drawn were those about the south American, Portugese and Spanish transition ….

- The EC stopped treating Romania as in need of “developmental assistance” in 1998/99. The PHARE programme was phased out - the focus shifted to training for EU membership and the implementation of the Acquis (using the TAIEX programme). Talk of differences in political culture was seen as politically incorrect – eastern countries simply had to learn the language and habits of the European social market and, hey-presto, things would magically change……

- 30 years on, the names of Bulgarian and Romanian institutions and processes may have changed but not the fundamental reality – with a corruption which is nothing less than systemic.

- The billions of Euros allocated to Romania since 2007 under the EC’s Structural Funds programmes have compounded the systemic and moral corruption which affects all sectors.

- The Cooperation and Verification Mechanism is, after 14 years, deeply resented – despite the increasingly clear evidence of the collusion between the Prosecution and the Secret services…..

Historians of different sorts have, of course, published numerous books mapping what happened in each of the countries after 1989. Tom Gallagher is particularly good on the political aspects of Romania with “The Theft of a Nation – Romania since Communism” (2005) and “Romania and the European Union; how the Weak Vanquished the strong” (2009)

But I know of only two English-language texts which have tried to analyse both economic and political aspects -    

The Great Rebirth – lessons from the victory of capitalism over communism ; Anders Aslud and Simeon Djankov (2015) which tells the story from the view point of some of the key actors at the time

Ruling Ideas – how global neoliberalism goes local Cornel Ban (2016) which is a left-wing Romanian critique of how neoliberalism got its grip on that society

I’m using this post to signal an interest in pursuing this issue - working at the moment with the following sorts of questions -

- how do we confirm that these countries have polarised systems? Presumably with the annual Eurobarmeter reports?

- how do we find out what conciliation efforts have already been attempted - let alone lessons learned in BG and RO? South Africa had hundreds of such efforts 

- how would effective and "trustworthy" mediators be identified? There’s an Association of Conciliators here in Romania presumably for commercial and family disputes but perhaps they have relevant resources?

- who are the key actors who would be involved in any such meeting?

- how do we identify the positive lessons from other efforts throughout the world to bring societies together? Latin America clearly has had many such efforts

- how do we deal with the cynics who dismiss such experience as irrelevant to their country?

Impervious power

For more than a decade I lived and worked in states in central Asia and central Europe which were (and remain) systemically corrupt – my work being in “small islands” of institutional improvement which had been negotiated as part of a much wider international reform effort. 

In Transit- notes on good governance” was the little book I used as a calling card in Uzbekistan (3 years); Azerbaijan (2 years); Kyrgyzstan (2 years), Bulgaria (2 years) and, more briefly, Romania (whose project management I could take for less than a month), 

I devoured the literature first on “transitology” (early reading was captured in the 2nd chapter of "In Transit") and then on “anti-corruption”….and tried, in various papers, to make sense of my experience .

In 2007 I brought my critical thoughts together in a paper Missionaries or mercenaries? presented to the Annual Conference of Network of schools of public admin in central and eastern Europe which I updated in 2011 as a result of an important policy paper about the European Commission’s programme of Technical Assistance  which tried to address the criticism.
That second paper was called The Long Game – not the log-frame – and, in it, I coined the phrase “the impervious state” because of the ease with which, for various reasons, systemically corrupt political regimes have been able to deflect criticism (both domestic and from international bodies) like water slipping down a duck’s back. Sadly, the phrase didn’t stick but states continue to be (ever more) impervious to public discontent.

And, equally sadly, Romania is a prime example of both this systemic corruption and apparent public indifference. There were no celebrations at the beginning of the month – when the country might have been expected to be celebrating what was, after all, the tenth anniversary of its membership of the European Union and when indeed it was celebrating the 27th year of freedom from the iron grip of Ceaucescu.

Privatisation was a policy insisted on by global institutions after 1989 but was favoured by apparatniks and leaders of many political parties in the region as a means of enriching themselves.
State bodies were left alone - as the fiefdom of these parties - with “reform” efforts consisting basically of new acronyms and rhetoric. 
Lack of any serious reform efforts meant that Romania had no chance of being allowed into Europe in 2004. Although its membership was approved in principle in 2005, a system of annual monitoring and verification reports was installed from 2005 - and is actually still in place for judicial reform. Indeed its eventual membership was allowed 3 years later largely because of the reform efforts of the Minister of Justice Monica Macovei - appointed in 2004 by newly-elected President Traian Basescu

It was however typical that the very day after Romania entered the EU (and therefore escaped most of its “conditionalities” ), the Romanian Senate voted for Macovei’s resignation which duly came the following month…..  – just one of so many attacks over the years by politicians and the media on attempts to sustain an independent judiciary

The Anti-Corruption Agency (created in 2003) has managed to hang on….although it is clear that many of the subsequent convictions have been on the basis of tenuous evidence…..public support remains high (judging perhaps it better to have a few“Al Capone” type convictions than let the systemically-corrupt walk free)….
 
It is remarkable how few Europeans know (let alone care) about Romania. Tom Gallagher is an academic who published his Theft of a Nation – Romania since Communism in 2005; Romania and the European Union - how the Weak vanquished the Strong (2010); and has written over the years frequent columns for the European and Romanian press. His interests, however, are much wider which means that the occasional article by outsiders who know little of Romania (such as these by Dennis McShane and David Clark) can so easily (and shamelessly) mislead.
Gallagher must have French and German equivalents but I don’t know of them…. 

Alina Mungiu-Pippidi is a highly respected academic indeed one of the world’s foremost writers on anti-corruption efforts (now based in Berlin) but her efforts to help her country are attacked by the local corporate media….since she is seen as parti-pris…..Here is a typical piece she wrote about her country’s successful efforts in outsmarting the EU.

Poetry, Potted history and Geopolitics - "In Europe's Shadow"

The search for books which (try to) capture the soul of a country is an increasingly fascinating endeavour for me. Such books cannot be contrived novels or dry histories – the few exemplars I come across are generally travelogues containing a mixture of encounters (with contemporary or historical figures) and feel for landscapes and cultural contexts……

Until now none of the english-language books on Romania (one of the dozen or so countries I’ve lived in over the past 26 years) has been able to do the country justice – although there are a couple of very impressive histories (Boia's Romania - Borderland of Europe; and Djuvara's A Brief Illustrated History of Romanians); two very challenging takes on its post 1989 politics (by Tom Gallagher) -Theft of a nation – Romania since Communism and Romania and the European Union: How the Weak Vanquished the Strong; and two travelogues - one from the indefatigable Irish writer, Dervla Murphy - Transylvania and Beyond (1992) - as she ventured into a country whose borders were open for the first time for 50 years; and a delightful 1998 book produced by a Frenchman (with photos by an Italian) – and accessible on google - The Romanian Rhapsody; an overlooked corner of Europe by D. Fernandez and F Ferranti (2000)

But Robert D. Kaplan’s In Europe’s shadow: two Cold Wars and a thirty-year journey through Romania and beyond (2016) now slips into top place of a unique annotated list I prepared 2 years ago of books which anyone seriously interested in Romania needs at least to know about. You’ll find that list in Mapping Romania - notes on an unfinished journey
He reveals in the Prologue that his first foray into the country was in the 1970s as a bemused backpacker in central europe; but that in 1981, as a 29-year old with few career opportunities, he spotted a hole in the western media coverage of south-eastern europe and took a flight to Bucharest in what seemed then a forlorn hope of whipping up some media interest in the area…..  
Kaplan’s writing is like the places he visits. It’s a terrain, a concentrated expression of a particular part of the world as he sees it, a very personal account though steeped in broad historical knowledge and familiarity with a wide range of sources. Kaplan’s sentences are like streets that lead us around a place we come to know through his eyes, either only through his eyes if it’s a place few people know (such as Romania)…….
It’s not a question of whether he’s got it right or wrong (Does the landscape really look as he describes it? Is his history of a town or a local population or a people accurate?).
 There is no right or wrong in this kind of writing. What we get is Kaplan’s view of the world and what matters is whether it compels our attention, becomes memorable and integrated into our own understanding. After all, we all know so little of it first-hand. Maybe one day we’ll go here or there, or at least in the neighbourhood, and we’ll know if it looks and feels familiar.
Kaplan is not a tourist, he’s a traveller. He doesn’t look, he sees. He’s not a visitor going from monuments to battlefields but one who lives his travels, immersing himself in every new surroundings, picking up—what makes us envious—new friends and colleagues that continue with him through decades.

This is the fourth Kaplan book I’ve read. As he explain in this Youtube presentation his latest book is a new departure with previous books (covering Asia, the middle East, Africa, the Mediterranean) giving horizontal slices to regions but this one being a “vertical” take on one country to which he has returned frequently in his life and by which he is clearly moved… 
There can’t be many Americans who know as many Romanians or as well as Kaplan, who is, so far as an outsider can get, inside as well as outside Romanian society and politics. And there may be no American who is so much simultaneously a travel writer and a geopolitical analyst, and happy to be so. When he discovered Romania in 1981 during the Ceausescu Communist years, “I felt that I was finally beginning to do what I always was meant to.” Kaplan, in other words, became not just a travel writer or a serious scholar. He had a vocation. 
"In Europe’s shadow" amounts to a kind of historical anthropology plus geopolitics, a deep study of a particular country and people. The point is to understand Romania itself and to use it as a way to apprehend Europe’s complex past. Romanian history involves the West and East, the geography between Western Europe and Greater Russia, more precisely the web of historical patterns and contemporary geopolitics between Central Europe and Eastern Europe. It’s a story that continues to be relevant today………………..
Those familiar with Kaplan’s work know that he’s as much a travel writer in the grand style as a geopolitical Realist whose studies of international relations and political leadership are also in the grand style, stretching intellectually over centuries and continuities of ideas.

As for the focus on Romania, it “was my master key for the Balkans... the Poland of southeastern Europe in terms of size, demography, and geopolitical location...” In Europe’s shadow is a demanding book for the lay reader but it shows how, at one and the same time, Romania is distinctive and a key to a broader and deeper understanding of contemporary Europe.
Most of all, Kaplan’s work exemplifies rare intellectual, moral and political engagement with the political order—and disorder—of our world.

The bibliographical references are impressive – although what seems to be an exhaustive list curiously fails to mention the only 2 serious studies of contemporary Romanian politics (by Tom Gallagher) - choosing instead to focus on older texts of Eliade and Cioran.....
My charitable interpretation of this omission is that Kaplan is not all that interested in contemporary Romania - despite a conversation with the previous PM and President.  Readers might have expected more than his superficial impressions of new constructions; the brightness (or otherwise) of paint or the lawn upkeep of Bucharest's parks...and to find some allusions at least to the scale of political corruption and the apparent success in the last 2-3 years of the new judicial system in throwing politicians in jail.....
But geo-politics, it seems, sees such issues as fairly minor..........

EU credit

This blog admits to sharing the general cynicism about the political process. All the more important therefore to recognise when positive efforts show results. Last week’s astounding victory (by a 10% margin) in the Romanian Presidential elections of a quiet outsider took everyone by surprise – he was down by the same margin after the first leg of the elections - but what happened in the subsequent two weeks has given the country its first real opportunity in 25 years to change an utterly venal system. 

Something seemed to snap this month for many Romanian citizens. They are used to smugness, arrogance, lying and deceit from their politicians – although the past two years have seen an increasing number of those politicians being actually tried, convicted and locked up. The Prime Minister (and Presidential candidate) Ponta epitomised their breed – having been groomed by a previous Prime Minister Adrian Nastase (2000-2004) who became in 2010 or so one of the first politicians to be fingered by a judiciary which was given its head by the terms of Romania’s entry to the EU in 2007 – and specifically by the Cooperation and Verification Mechanism
At its heart is the National Anti-Corruption Agency (DNA) whose officials bring the prosecutions which (tenured) judges at last are happy to uphold. (Not that this stops the Romanian Parliament from trying to give its deputies special immunity!)
But blatant attempts at vote-rigging in the last few weeks proved too much for voters - and seem to have been the spur for an astonishing jump of 2 million additional people voting in the second round – more than enough to wipe out the 1.5 million lead which Ponta had in the first round.

Stunning as this victory of decency seems to have been, we need to understand that it has come about only as a result of long, hard and patient work not only of a few Romanian heroes and heroines but of a group whose reputation has become a bit more tarnished these days - namely European technocrats who - as long ago as 2004 - set in place measures to make the Romanian judicial system work. It has been a long struggle which came to a head in 2012.

Ponta had been Prime Minister for only a few weeks when, in summer 2012, he sparked off a major constitutional crisis which I covered on the blog during July of that year and summarised in this postTom Gallagher (who has given us a couple of books about post 1989 Romania - one of which is significantly called "Theft of a Nation") gave the best overview then
A 22-page report from the European commission says the new government, led by Ponta, has flouted the constitution, threatened judges, illegally removed officials in an arbitrary manner, and tampered with the democratic system of checks and balances in order to try to secure the impeachment of President Traian Basescu……....The crisis erupted because of the massive over-reaction by the new government of Victor Ponta to court decisions sentencing political figures, previously thought to be beyond the reach of the law, to prison terms. Romania had joined the EU (in 2007) on terms that largely suited a restricted post-communist elite that benefited from discretionary privatisations of the economy while pulling the strings in many of the key institutions of state.
A once lively independent media was mainly captured by the new power magnates. Parliament devised rules for itself that made challenges from new social forces very hard and protected its members from prosecution. 
Aware that there was a real danger of Romania becoming a festering political slum within the EU, Brussels officials showed firmness in one key area, the justice sector. The Romanian elite agreed, in 2004, to Brussels having oversight of the justice system even after entry in 2007.The EU has shown consistency by insisting on a proper separation of powers and the gradual creation of a justice system not impeded from going after top politicians, businessmen, civil servants and judges who face credible charges of corruption. 
For the last eight years there has been a messy power struggle between the old guard, determined to hold the line against encroachments on their power, and a small group of reformers in the justice system and the party of Democratic Liberalism that held office until April. They have mainly been sustained by President Traian Basescu, a rough-hewn and unconventional former ship captain in the Romanian merchant navy. 
Basescu is hated by much of the elite because he defected from their ranks and decided to try and make his legacy the cleaning up of one of the most venal political systems in Europe. In the process, leading figures in his own party have not been spared. This led to a string of defections that explain why his most implacable enemies in the Social Liberal Union were able to return to government this spring (2012).Their original intentions had been to wait until parliamentary elections in the autumn before removing Basescu. They were predicted to produce a big win for them due to the unpopularity of tough austerity measures that Basescu had championed in 2010-11.
But panic set in with the prison sentence for Nastase. Prudence was ditched entirely when the British journal Nature published an investigation revealing that 85 pages of the new Prime Minister’s thesis had simply been copy-pasted from other sources.It was decided that Basescu would have to be eliminated from the political game straight away. But that could only be accomplished by neutralising bodies like the Constitutional Court and the Ombudsman, seizing control of the official gazette so that the government could publish or suppress whatever laws and rulings it pleased, and removing the heads of the bicameral parliament in contravention of the rules for this.
President Basescu was unpopular – being associated with austerity measures and being a hyperactive loudmouth. More than 80% of those who voted in the 2012 referendum called to impeach him therefore wanted him out (although the President had called for a boycott) but it failed since only 46% of voters turned out. After this, things quietened down. A report earlier this year from The Sustainable Government Indicators project gives a detailed analysis of events since 2012.
In a few days he will stand down – and could well then face prosecution himself by virtue of his role (as Minister of Transport) in the privatisation of Romania’s shipping fleet for what some people allege to have been too low a figure. As far as I am aware noone suggests that Basescu benefitted....For Romania's sake, I hope this issue does not become another scandal.....

It has taken all of 2 years for Ponta to get the "come-uppance" he so richly deserves.
And for the EC to begin to deserve the Nobel prize it won a couple of years ago

European Hubris

It’s difficult these days to be objective about the European Union – the combination of the euro crisis, austerity and the immigration set off by the 2004 widening has given so many easy targets and scapegoats.
“The European Project” went from strength to strength (with a short breather until Delors became President in the 1980s) – until hubris set in at the start of the new millennium. The Euro was launched in 2002 with a great fanfare but, in less than a decade, has dragged the entire project into disrepute; the attempt to foist a new Convention on European Nations hit major hurdles very quickly with French and Dutch rejections of the draft in 2005. All the while, however, the European Court of Justice has been throbbing quietly in the basement, supplying the legality if not the legitimacy to the regulations drafted by the Commission with its supportive infrastructure of lobbyists and officials.

Intellectual coverage of this unique venture has been massive – with academia queuing up to receive generous European funding. Did you know, for example, that there were, at the last count, 409 Jean Monnet Professorial Chairs in European Universities – funded for the initial 3 years by the EU? Four Hundred and Nine!!

The natural scepticism of journalists has been kept in place by a combination of EC press releases; editorial control of newspapers whose owners are (to a man) pro-European; and by budgets which no longer permit detached scrutiny.
I told you it was difficult to be objective!

The UK, of course, is home to “the awkward squad” which has an innate resistance to overblown rhetoric and projects. Tom Gallagher’s latest book - Europe’s Path to Crisis – disintegration via monetary union - is a great read in that tradition eg the 2003 blockbuster “The Great Deception – can the European Union Survive?; the rather more philosophical The Tainted Source; and the incendiary 1995 book The Rotten Heart of Europe –the dirty war for Europe’s money by one of the guys behind the moves toward monetary integration (Bernard Connelly) whose detailed analysis was so explosive that he was not only sacked from the Commission but banned from further critical writing on the subject. Curiously for a book which was honoured with a Danish award for moral courage, Amazon cannot offer the book – not give any comment on it   

Tom Gallagher, whom I readily admit to being a friend, is no stranger to controversy - with a fascination for the undergrowth of political activity not only in the Balkans (an early specialism) but in the Celtic fringes of Portugal (1980s) and Scotland (most recently). Romania hardly qualifies in that category but has been a fruitful harvest for his ruthless probing - initially with Romania – theft of a nation, latterly with Romania and the European Union – how the weak vanquished the strong (2010)  

Possibly it was that second book which gave him the idea for this latest book which is very clearly not another technical study of the eurocrisis - but rather a very political analysis (with scrupulous references) which carries an unspoken question about hubris.    
His “Europe’s Path to Crisis” has inspired me to try to identify the more balanced of the critical writing on Europe - particularly those which can go beyond the critique and have an alternative agenda which might be worth exploring. To reach these (rare) sites, you have to wade through not only angry nationalist sites but also some which purport to be critical but which turn out to have European funding!
The best guide is probably this recent one from Cardiff University. I doubt, however, anyone has a realistic agenda which can satisfy both multinational interests and the frustration of European citizens.....
The recent appointment of Juncker as President of the Commission was hardly calculated to inspire confidence (not that this has ever seemed a consideration for the European political class) but recent revelations about the tax evasions which have been an integral part of the Luxembourg system over which Juncker presided for so many years so seem to be the last straw.

My surfing also threw up this interesting book on The sociology of Europe - and my mail, coincidentally, this New Pact for Europe - produced by a collection of worthy Foundations (including the Bertelsmann and Gulbenkian ones). 
Great rhetoric - but little reference to the hard economic, ecological and political realities I have been writing about in recent posts (the bibliography kills the report's credibility for me).

Theft of a nation

As I was writing yesterday’s post, I realised how little I knew about how the restitution of Romanian property (seized by the communists a half-century ago) had actually been attempted in recent years.
It seems I am not alone! The assessments seem to be subjective, confused and out-of-date. I was particularly disappointed by the 2008 study Property Restitution - What went wrong in Romania? by the Romanian Academic Society which promised to tell all but from which I emerged little the wiser - but at least knowing that the Romanian process was indeed distinctive (in central Europe) in its laggardly and utter confusing approach
A very short article in a recent issue of Journal of Property Rights in Transition updates a substantial and enlightening 2006 academic article on the subject entitled The Roof over Our Heads: Property Restitution in Romania; by Lavinia Stan - in The Journal of Communist Studies and Transition Politics, Vol.22, No.2, June 2006, pp.180–205 (which can be accessed and downloaded from www.academia.edu
Until 2005 successive Romanian governments blocked attempts by owners to recover their dwellings, siding with the tenants who were using the dwellings (well connected political, business, and cultural luminaries) against the owners (elderly persons or residents of foreign countries). Only 5 percent of all owners received their homes back. In 2005, a Property Fund (Fondul Proprietatea) started to compensate owners whose properties could not be returned because they had been demolished, bought by the tenants living in them, or (abusively) retained by the government offices (mayoralties and ministry departments) using them. The Property Fund relied on shares in large state-owned companies.
Because it was constituted over 15 years after the privatization process was launched, during which most such companies had been transferred into private hands, the Fund controlled few assets effectively. As such, many owners continued to receive neither property, nor compensation. Executive interference in the activity of the judiciary meant that many courts disregarded procedure and infringed both the Romanian Constitution and the European Convention of Human Rights when hearing restitution cases, thus prompting an increasing number of owners to approach the ECHR. This is why in 2010 the Court asked the government to revamp its property restitution scheme.
From October 2010 to April 2013 Romania did nothing to comply with the ECHR request. The vested interests of powerful political elite members in retaining ownership of the nationalized dwellings by disregarding the rights of the owners explain why the authorities did not consult with the owners, although consultations were recommended by the Court and would have involved little effort.
Political instability was also at play. There were no fewer than four cabinets during that time period (headed by Prime Ministers Emil Boc, Mihai Razvan Ungureanu, and Vasile Ponta), the first three of which were weak cabinets delegitimized by scandals, frequent replacements of ministers, and an unclear policy direction. Instead of solving the restitution cases, by providing the Property Fund with the means needed to compensate owners, punishing Fund leaders for mismanagement and waste, and protecting owners from undue pressure to renounce their property rights, these governments perpetuated an untenable system.
According to some reports, 1,000 intermediaries well connected to the Fund cashed in 1.5 billion Euros for property claims they brought from disillusioned initial owners, who simply gave up the fight. These intermediaries received compensation at higher rates and faster than thousands of owners whose claims the Fund refused to consider promptly and honestly.
All of this serves to prove just how right Tom Gallagher got it with the subtitle for his 2005 book Romania – theft of a nation. And his 2006 article for Open Democracy is perhaps as pithy a summary as you will get anywhere of this kleptomania and how it has been sustained.

And I see that this book by Lavinia Stan has just been published Transitional Justice in post-communist Romania – the politics of memory

Hypocritical Europe?

Today's previous post tried simply to describe the latest developments here in Romania. This second post today reflects conversations with local people and is a comment.
European input to Romania’s ongoing political crisis is a delicate matter. It can all too easily become counter-productive. There are many educated Romanians - and they are highly intelligent, proud and touchy – and can quickly spot apparent inconsistencies if not hypocrisies in comments from Brussels and BerlinFor example -
  • Italy and Greece have been hotbeds of corruption, blatant disregard of rule of law and conflicts of interest for decades - and yet Europe took action only recently when its own financial stability was threatened. 
  • Romania’s (suspended) President has been overstepping his role for several years, acting unconstitutionally on several occasions and yet Europe said nothing. This week’s judgement of the Constitutional Court apparently agreed that Basescu has been usurping the Prime Minister's role - although most newspaper reports focus only on their agreement that due procedures were observed. 
People with no axe to grind in the present stand-off are asking why Romania is being picked on in this way. A lot of people believe that Europe is so hostile to Romania that it is looking for a reason to kick them out.
Europe therefore needs to tread carefully – and spell out clearly the basis for its concerns. Officially, Romania obtained membership of the European Union in 2007 only because it was judged to have satisfied certain basic conditions – ie of being a functioning democracy and market economy. Any sign that the rule of law is not being respected is a more worrying signal in a new state than an old member state – since such things take time to bed down. In that sense all member states are not equal (Can one take seriously a Constitutional Court which has taken three different positions in 3 years about the rules for a referendum to impeach the President???). Why else is Romania subject to these 6 monthly tests???
A year ago I drew attention to an important distinction a Czech discussant made  -
between democracy understood as institutions and democracy understood as culture. It’s been much easier to create a democratic regime, a democratic system as a set of institutions and procedures and mechanism, than to create democracy as a kind of culture – that is, an environment in which people are actually democrats
My old neighbour will be voting for the impeachment – most old villagers follow the socialist party line. But he does not appreciate constitutional niceties – for example, removing the next in line for the Presidency a few days before the removal of the President may not be unconstitutional in the strict sense - but it is in fact a profound undermining of the essence of constitutionality. If the beef is with Basescu's behaviour, then why not accept the next in line - also a PDL member? Removing him before he could take up the interim position demonstrates the attack is a wider political one - concerned to pack all institutions with yea-sayers. That's a coup d'etat! I'm surprised more commentators have not focussed on that.
Independent analysts such as Tom Gallagher and Alina Mungiu-Pippidi have spelled out in many papers and books over the years just how deviant the political class is here (Tom's latest in his 2009 book Romania and the European Union - how the weak vanquished the strong; Alina's in her chapter in the 2009 book Democracy’s plight in the European Neighbourhood).
The issue is how Europe explains to the Romanian voters that they are still under assessment - without driving them into the arms of the ultra nationalists???
So far, I've had no response from my brief letter to David Martin MEP. And the European Parliament seems to be splitting on political lines - with the Head of the Socialists and also of the Liberals siding with Ponta

Missing history of administrative reform


Worked non-stop all Saturday on this briefing paper on Chinese administrative reform (Friday’s draft is here). Two developments got the creative juices flowing - first I discovered a method for giving my website papers higher visibility on the internet - I simply choose a title for a blog posting which is the same as one already on the first page of google search and then ensure there is a link in the blog post to my paper! So, as I scribble (or whatever word now captures the key tapping we all do now) I can imagine my phrases and insights hitting a spellbound global audience. Dream on!
Then, as I was grappling with the question of the lessons from 40 years of reform efforts in Western Europe, I was suddenly reminded of my 1999 book - in which I had tried to explain west european public admin reform to a central european audience. I was amazed to find that the argument and text still stands up pretty well eleven years on – and have duly uploaded it to the website - In Transit - notes on Good Governance Part I. What I had tried to do in chapter Four of that book was to emphasise how varied were the „explanations” we had in the 1970s about the sort of problem which required „reform”; and, therefore, how differently (despite the talk of New Public Management - NPM) reform programmes developed in different countries. I had also explained how, in the 1970s, the new breed of policy analysts had almost given up on the hope of getting the bureaucracy to operate in the interests of the public - „disjointed incrementalism” was the best that could be hoped for. And how public choice theory came along to give an ideological explanation and justification for what came to be called NPM. I was fighting bureaucracy in the 1970s and 1980s with a different (and simpler) theory – what I called the „pincer approach”- a combination of community action and strategic management led by politicians and explained in paper 50 of my website – Organisational Learning and Political Amnesia. In the 1980s, I was using the pamphlets of the Institute of Economic Affairs (on issue like road-pricing) with my students to show the practical applications to which economics could be put – never imagining that such neo-liberal thinking would soon dominate government policies. But in the mid 1980s I remember reading a long article by a neo-liberal American academic in The Economist about the need to introduce a split between purchasers and providers into the health system – and sending it with a warning note to the (Labour) Opposition spokesman in Parliament.
The technocratic fix of (young) consultants misses completely this politico-historical side of things – and I realise that my personal history (and extensive reading and international experience) gives me a fairly unique perspective on this issue of administrative reform. Anyway it encourages me to think I have!

And that is a good opening for a bit of trumpet-blowing. I got a very nice note a few weeks back from Tom Gallagher (author of Theft of a Nation – Romania since Communism and Illusion of Freedom; Scotland under nationalism and many other books) whom I had met up with for the first time in Bucharest in late November. He has kindly given me permission to reproduce his note which read -
“I came to Carpathian Musings fairly late in the day but I soon grew to appreciate the intellectual fire-power and also the aesthetic pleasures to be derived from following your thoughts and also your experiences in Romanian city and countryside. Indeed, I can't think of any other blog that works so well at very different levels; you are able to switch (seemingly effortlessly) from discussing the current deep politico-economic crisis, to appraising the books you are reading, casting a beedy eye on the delusional university world, to passing on your experiences as a bon vivant, sampling the cornucopia of seasonal foods, wines and your trophies from the fairs and antique market. You also explore your own life in an honest and constructive way. So you manage to be a cross between JK Galbraith, Fred Halliday, Egon Ronay and Dennis Healey - quite a feat”.
Praise indeed - particularly from such a writer! I have been trying to insert it as one of my list of quotes in the right-hand column of the site but have been foiled so far!

A Fine Mess


Let me clarify - the pessimism I feel about the performance capacity of governments relates to my experience and understanding of (a) the UK system since 1968 (when I started my councillor role which was to extend for 22 years) and (b) the so-called transition countries of Europe, Caucusus and Central Asia in which I have worked and lived for the past 20 years.
I have a more open mind about the situation of the Scandinavian countries (in one of which I have briefly worked and lived); of Federal Germany and of the consenual Netherlands (although consensual Belgium and Austria have been disasters). But the UK system has become ever more centralised and adversarial in my lifetime - and these two characteristics seem to me to affect the chances of policy success in the country –
• Policies are imposed – rather than negotiated or thought through
• They are often very poorly designed (eg the poll-tax; rail privatisation; the whole Stalinist target system – with all the counterproductivities that involves)
• Ministers have a high turnover rate (Ministers of Finance excepted)
• Implementation is very poor (see agency theory)
• Morale of public servants is low (political hostility; targets; frequency and number of new initiatives; crude management)
• Changes in government lead to cancellation of programmes

Governance arrangements as a whole do not excite much interest in Britain – but issues relating to the operation of the political system (and of what is felt to be the disenfranchisement of the citizen) do. Concerns about the British political system were so great that a highly ironic report on the operation of the British system was published by Stuart Weir and Democratic Audit to coincide with the launch of the campaign. A very good blog put the campaign (and its prospects) in a useful wider context. If you go back to the diagram at the end of key paper 5 on my website, the electoral system (box 4 top left) is actually only one of 10 sub-systems which have a bearing on the operations of public policies. But (as the 2nd of my blog masthead quotes indicates) it is probably of supreme importance. Which is why the political system so rarely gets reformed (apart from local government!)
I vividly remember a book in the late 1970s (Google does not go that far back!) which looked at various policy initiatives to try to identify the preconditions for successful social policy-making (feasibility and support were 2 of them) and which could produce only a couple of succesful policy examples - one of which was the Open University (I would add the Scottish Children’s Hearing approach to juvenile justice which was introduced in 1968 and which appears still to be going strong .
I would dare to posit that there was probably a Golden Age of government capacity in the UK – not only further back in time (when the political elite were not assailed by the media, lobbies and think tanks) but also further down in space. David Marquand’s recent magisterial neglected arguments of Leopald Kohr. I appreciate the arguments of Gerry Hassan and Tom Gallagher about the potentially incestuous nature of political systems in a small country (Hassan talks about the bunker mentality) and Belgium, Iceland and Ireland have hardly surrounded themselves recently with glory – but the issue of decentralisation of power must be one of the options countries look at in our present global crisis.

China is in the news again – with its attitude to the award of the Nobel peace prize to Liu Xiaobo. There are (and have been) so many courageous individuals in that country – and now even some older members of the elite are calling for an end to the restrictions of freedom of expression…. I liked the jokes which are now apparently circulating about the situation.
But apparently even the Prime Minister is censored!

As I’ve been writing this, Romanian radio has been playing some Stockhausen which has similarities to Kyrgyz nasal music!!

Romania's stark realities - and what is to be done?


British insularity is such that, over the past century, there have been only a handful of academics with an interest in Romania. In the first two decades of the 20th century it was Robert Seton-Watson – whose contribution to the very existence of Czechoslovakia (as it then became) overshadowed the role he played in Romania’s development. Twenty years or so ago, Dennis Deletant and his wife were important for their contributions to our understanding of the Romanian language and of its infamous security systems. Since then Tom Gallagher has taken up the baton – although with a more aggressive stance toward his subject matter (which he has also adopted to his more recent focus on Scotland)
On a visit last week to Bucharest’s English bookshop, I noticed that Gallagher produced last year a new book about about Romania and its access to the EU. Amazon can generally offer cheaper versions – but my visit to its website gave me the astonishing price of 57 pounds. There was however a very extensive review by a former British Council Lecturer (Christopher Lawson) in Romania during the Communist era (1976-1978) who returned to Iasi at the end of 2003 and now works as a writer-editor. With his kind permission (15 October) I offer the following excerpt from his review - since it gives such a good overview of the country's recent development.
And what impression of the country might a tourist take away in 2010? Western sales engineers descend from planes and gather for breakfast in Romania's international hotels. Shiny high-rise buildings rise in city centres. Well-fed Romanian businessmen attend backslapping Rotary meetings and travel from the provinces by train to the capital in comfortable sleeping compartments, or in sleek new cars which clog the overcrowded roads. The wares on sale in the supermarkets compare with those they are used to in the West. Fresh fish from the Atlantic and the Mediterranean is delivered daily to the French hypermarket chain Carrefour. Young people clad in the latest fashions patronize chic restaurants and cafes, leaving in glossy cars or on Kawasaki motorbikes. Top names come to give concerts in the capital. The nouveaux riches flock to the stadiums and concert halls. Ambitious students seeking their fortunes opt for business or law, and graduate with a good knowledge of English and the Internet. A ruthless win-lose attitude prevails in business.
Meanwhile tens of thousands of peasants live in grinding poverty, with no electricity or running water, while employees of the State, notably teachers and doctors, struggle from month to month. The same kleptocrats, generally Securitate officers who once informed on their fellow-citizens, inheritors of the Stalinist system which once prevailed, sabotage numerous projects to improve the villages. I live on the university hill in Romania's second city. Nearly every time I visit my rubbish dump, I meet poorer residents picking through plastic bottles and discarded clothes. Corruption holds sway, especially in justice, education, medicine and tenders for road construction.
Whatever a "normal" post-Communist country may be, Romania does not count as one, despite appearances to the contrary. Tom Gallagher tells us why.
His new book analyzes those 20 years, especially the more recent ones. Meticulously researched, written with the pace of a thriller, and in the final analysis endlessly depressing, Romania and the European Union confirms Gallagher's position in the front rank of historians of, and commentators on, post-Communist Romania.
The book, Gallagher's third on Romania, documents how old-guard, predatory kleptocrats have continued to enrich themselves, trousering millions, much of it cash from EU funds, while consistently blocking substantial reforms in key ministries. Meanwhile EU officials at all levels, alternatively complacent, deluded, indecisive or just plain feckless and lacking willpower, have, with a few praiseworthy exceptions, allowed Romania into the world's most successful economic and political grouping without having made these vitally necessary reforms. Brussels was deceived.
So-called European Social Democrat leaders share the blame. Many praised Romanian leaders whose corrupt behaviour shrieked to the skies. In particular, it is clear that the acceptance of the PSD, the former Communists, into the international centre-left family of the Socialist International was a catastrophic error.
The Romanian ex-Communist elite deployed the full panoply of Balkan wiles to outwit the European negotiators. They bestowed honorary doctorates on visiting or resident Eurocrats. Following ancient Phanariot tradition, they even provided bedmates for high-level EU representatives. They prevaricated, protected their own and pretended to implement reforms while preventing them from biting.
From the pages heroes, heroines and villains arise. The villains, all of whom are well-known, outnumber the heroes and heroines. Not a single corrupt politician has been successfully prosecuted or served a full custodial sentence. The EU's wish to have a number of heads on a plate, dripping with blood, has not been granted. Experts say the real progress in the fight against corruption and organized crime is measured not by the number of arrests, but by simple indicators: convictions by a court in a fair trial, the amount of dirty money confiscated, or the number of illegally acquired properties taken away. And such efforts have not yet been seen.
To all of which I can only – but very sadly – say "hear! Hear!” And it is particularly good to see the role of western agencies being properly emphasised. It does indeed take two to tango.
The question, hoever, to which I constantly return is what might a relevant reform strategy look like for kleptocracies such as this? For the past decade, in various papers available on my website (number 1 gathers it all together), I have been bemoaning the failure of Western agencies and programmes of Technical Assistance to recognise that the fashionable mantra about „good governance” their experts were peddling was sheer snake-oil in these conditions and countries. Grindle’s “Good Enough Governance Revisited”was one of the few papers which gave my stance any backing then. For some time I have been consumed by two simple questions a what and a where.
First – what approach should I advise genuine reformers in the machinery of government in countries such as Azerbaijan, Bulgaria, Georgia, Kazakhstan or Romania (let alone middle eastern countries such as Jordan) to take? The public sector of course of each of these countries is at a particular stage – and each faces its own unique configuration of constraints and opportunities – so the approach has to start from that unique combination of forces. But what would the generic elements of the approach contain? Varous papers on my website paper contain some elements - not only the one I have already mentioned but also a couple of papers on Azerbaijan. But these were drafted some years ago (for very particular audiences)and do need some considerable revision to provide something more generalisable.
The second question is where do you find the reformers who are likely to have some staying power – both in positions of influence and as reformers? Sadly there does seem to be an „ïron law of oligarchy” (as Robert Michels put it 100 years ago) - which quickly sucks the originality and commitment out of reformers. This then leads onto a third question. I was very struck in a thread of discussion about Tom Gallagher’s latest critique of Scottish national politics by someone’s comment that such criticism is unfair since all governments quickly succumb to global capitalism. This stance is a real challenge – Margaret Thatcher put it very simply – TINA – there is no alternative. So why should we bother voting or engaging in activism of any sort? Why not take Voltaire’s advice – and just cultivate our gardens? To answer that question, people like me have to identify - and properly disseminate - the examples of sustained, positive, social change.
I’ve just started to dip into two books which I hope will help me with this - Will Hutton’s latest book Them and Us – and David Dorlings Injustice. Clearly these authors are very good on critiques and explaining the mechanisms which sustain inequity and injustice. But do they address the third question? Nous y verrons!
